A Verdict Beyond Its Jurisdiction

A disciplinary file can be marked closed while the safety assessment beside it is still marked preliminary. One concerns what an employee did; the other, what a system might do.

Your institutions can punish the delivery of a warning before evaluating its substance because a disclosure breach is often easier to prove than a future danger. No fabricated charge is required.

Consider a researcher who sends an internal report outside a laboratory. Access records may establish the transfer. A contract may establish the restriction. An investigator can reach a valid finding without resolving a single disputed sentence in the report. Assessing the warning may require new experiments and estimates of rare failures; even the meaning of a result can remain disputed. A dismissal can be ready for signature while the relevant test is still being designed.

In a meeting, a headline, or a colleague’s memory, “violated confidentiality” can become “untrustworthy,” and “untrustworthy” can become “wrong.” The first judgment concerns the handling of information. The last concerns its truth. The middle word permits the substitution by treating trustworthiness as a single property.

Misconduct involving evidence is different from misconduct involving its distribution. Fabricating measurements or concealing contrary results gives reason to doubt a report. Sending it to an unauthorized recipient does not, by itself, establish that its contents are false. The disclosure may still cause serious harm and warrant dismissal. Someone can be unreliable with a secret and accurate about a danger.

Faster discipline alone does not establish that a safety review has been displaced. The transfer occurs when the disciplinary verdict is treated as a refutation the technical inquiry has not supplied. No coordination is necessary: investigators can stay within their remit while audiences extend the verdict beyond it.

A correct finding about how a warning traveled can acquire the authority of a finding about whether it was true.
